These Terms of Service ("Terms") govern access to and use of the PixelForge design-to-code platform, including the Figma plugin and the associated web application (together, the "Service"), operated by [PixelForge Legal Entity Name], a company registered at [Registered Business Address]("PixelForge", "we", "us"). By installing the plugin, creating an account, or otherwise using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
If you use the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and "you" refers to that organization. If you do not agree to these Terms, do not use the Service.
2. Description of Service
PixelForge converts a Figma frame selected through our plugin into source code (React, Next.js, HTML/CSS, or Vue 3, depending on your chosen configuration) using a combination of deterministic processing and large language model ("LLM") inference. The Service is provided as a development productivity tool and does not constitute a design, engineering, or legal advisory service.
3. Accounts & Eligibility
You must be at least 16 years old to use the Service. You are responsible for maintaining the confidentiality of any credentials associated with your account and for all activity that occurs under it. Notify us promptly at [support@your-domain] of any unauthorized use.
4. Subscriptions & Payment
Paid plans (currently Pro and Team) are billed in advance on a recurring monthly or yearly basis, depending on the option you choose at checkout. Our reseller Lemon Squeezy acts as merchant of record: it processes the payment, charges applicable taxes and issues invoices. By subscribing, you authorize the charge of your chosen payment method each billing cycle until you cancel. You may cancel at any time through the subscription management link in your purchase receipt; cancellation takes effect at the end of the then-current billing period, you keep access until then, and no further charges will be made. Except as described in our Refund & Cancellation Policy, fees already paid are non-refundable. Each plan includes a monthly generation allowance shown on the pricing page; the counter resets on the 1st of each month. Prices, plan limits, and features may change with reasonable advance notice.
5. AI-Generated Code Disclaimer
The Service, including all code, markup, and configuration generated through it (the "Generated Output"), is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including without limitation implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Generated Output will be accurate, secure, bug-free, or fit for production use without review.
Generated Output is produced by deterministic software combined with suggestions from machine learning models (such as semantic tags and class names) and may contain errors, omissions, security vulnerabilities, or deviations from the source design. To the maximum extent permitted by applicable law, PixelForge disclaims all responsibility and liability for any damages, losses, or costs — direct, indirect, incidental, or consequential — arising from your use, modification, or deployment of Generated Output in any product, service, or system. You are solely responsible for reviewing, testing, and validating Generated Output before relying on it, and in particular before deploying it to a production environment. 6. Intellectual Property
As between you and PixelForge, you own the Generated Output produced from your own design input, subject to your compliance with these Terms and payment of any applicable fees. PixelForge and its licensors retain all rights, title, and interest in and to the Service itself, including the underlying software, models, prompts, and infrastructure.
You represent and warrant that any Figma file, design asset, image, icon, font, or other content you submit to the Service is either owned by you, licensed to you with sufficient rights, or otherwise lawful for you to submit, and that its use does not infringe the intellectual property, privacy, or other rights of any third party. You are solely responsible for any Generated Output derived from infringing source material.
7. Acceptable Use
You agree not to: (a) use the Service to build or distribute unlawful, infringing, or malicious content; (b) attempt to reverse engineer, extract, or replicate the underlying models or infrastructure beyond what is exposed through the Service; (c) circumvent usage limits or rate limits; or (d) interfere with the integrity or availability of the Service.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall PixelForge, its officers, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Service or any Generated Output, even if advised of the possibility of such damages. PixelForge's total aggregate liability arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, wilful misconduct, or, where applicable, the statutory rights of consumers in your jurisdiction.
9. Indemnification
You agree to indemnify and hold PixelForge harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your deployment of Generated Output in violation of applicable law or third-party rights.
10. Termination
We may suspend or terminate your access to the Service if you materially breach these Terms or engage in conduct that we reasonably believe harms the Service or other users. You may stop using the Service and cancel your subscription at any time.
11. Governing Law
These Terms are governed by the laws of [Governing Jurisdiction], without regard to its conflict-of-laws principles, except that if you are a consumer resident in the European Union or the United Kingdom, you also benefit from any mandatory consumer-protection provisions of the law of your country of residence.
